Terms of Service for NDIS.LINK

Agreement: By accessing or using https://ndis.link, you agree to be bound by these Terms.
1. Nature of ServiceNDIS.LINK, a project by Scriptify Pty Ltd, is a directory and networking platform. We provide a "link" between NDIS participants, support workers, and service providers.
Independence: NDIS.LINK is an independent platform and is not affiliated with, endorsed by, or a part of the National Disability Insurance Agency (NDIA) or the Australian Government.
No Agency: Scriptify Pty Ltd is not an employer of support workers listed on the site, nor is it a party to any service agreements entered into between users.
Eligibility: Users must be at least 18 years old or have legal parental/guardian consent to use the platform.
Accuracy: You must provide accurate and current information. For providers, this includes valid ABNs and contact details.
Security: You are responsible for maintaining the confidentiality of your login credentials.
The Process: Scriptify Pty Ltd manually verifies providers by checking ABNs and confirming contact details via phone, SMS, or email.
No Guarantee: The "Verified" badge indicates that we have confirmed the provider's identity and existence. It is not a guarantee of the quality, safety, or suitability of the provider’s services.
Due Diligence: Participants and coordinators are solely responsible for conducting their own background checks, NDIS worker screening checks, and interviews.
Processing: All payments for subscriptions or featured listings are processed via Stripe. By using our payment features, you agree to Stripe’s Terms of Service.
Fees: All fees are in Australian Dollars (AUD) and inclusive of GST unless stated otherwise.
Refund Policy: To the extent permitted by Australian Consumer Law, fees paid for "Verified" status or featured listings are non-refundable once the verification process has commenced. If you believe there has been a billing error, please contact us within 14 days.
Users must not:
Post false, misleading, or defamatory content.
Upload sensitive medical or health records (refer to our Privacy Policy).
Use the platform to "spam" other users or harvest data.
Circumvent the platform’s security features.
To the maximum extent permitted by law, Scriptify Pty Ltd shall not be liable for:
Any physical injury, loss, or damage resulting from a connection made via the platform.
The conduct of any support worker or provider, whether "Verified" or not.
Temporary interruptions to the website for maintenance or technical issues.
Maximum Liability: Our total liability for any claim arising out of these terms is limited to the amount you paid us (if any) to use the platform in the 12 months preceding the claim.
Platform Disputes: For issues regarding your account or our verification process, contact [Insert Email].
Inter-User Disputes: NDIS.LINK is not a mediator for disputes between participants and providers. These should be resolved through your private service agreements or escalated to the NDIS Quality and Safeguards Commission.
All content on NDIS.LINK, including logos, text, and the platform’s code, is the property of Scriptify Pty Ltd. You may not reproduce or use our branding without written permission.
9. Termination of UseWe reserve the right to suspend or terminate any account that violates these terms, fails our verification audit, or brings the platform into disrepute, at our sole discretion and without prior notice.
10. Governing LawThese terms are governed by the laws of South Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia for any disputes.
